Terms and conditions of service
Section 1. General provisions
1.1. This Agreement establishes the specifics of the provision of exchange services by the Online Service.
1.2. Sbs.cash Services refers to the services provided to you by Sbs.cash, which are offered through the website, widgets and mobile applications.
1.3. Sbs.cash offers a Cryptocurrency Exchange based on an Order that has been created by the User in the Service.
1.4. Users include individuals and organization(s) who have agreed to cooperate with the Online Service.
1.5. When referred to generally, the User and the Online Resource are referred to as the Parties.
1.6. The parties agree that this electronic Agreement has equal force with a written agreement and is intended to regulate their relations in the process of consumption/provision of exchange services.
1.7. The Agreement is considered a public offer, the acceptance of which occurs by filling out an application by the User to receive services provided by the Online Service. The application is submitted through the Sbs.cash website.
Section 2. Basic definitions used in the user agreement
2.1. The site user can be represented by any individual who uses the services of Sbs.cash and exchanges funds. A site user is considered to be any visitor to the site, regardless of whether he accepts the agreement and whether he carries out currency exchange transactions.
2.2. The payment system is a digital product that has been entirely developed and is the responsibility of a third party. The payment system can be represented by banks servicing cards (both physical and virtual, including electronic wallets). The Sbs.cash service is not responsible for errors and failures in the performance of payment systems.
2.3. A payment or financial transaction is the process of transferring funds (electronic or other currency) from the payer (website user) to the recipient (Sbs.cash service).
2.4. The client is a person who has entered into an agreement with the payment system for the storage and use of currency in the system. Property rights to the currency fully and irreproachably belong to its owner.
2.5. The application expresses the site user’s intention to use the service of exchanging funds in the Sbs.cash service and is filled out on the main page of the site (Sbs.cash). The condition for filling out the application is confirmation of familiarization with the user agreement.
2.6. The source currency is the electronic currency that the user intends to sell to the service in order to exchange it for another currency.
2.7. The source account is the number of the wallet, account or card number from which the source currency is transferred by the user.
2.8. The resulting currency is the electronic currency that the site user intends to receive as a result of the sale of the original currency.
2.9. The resulting account is represented by the number of the wallet, account or card number to which the resulting funds will be transferred from the service.
2.10. Currency exchange is a key process of cooperation between a site visitor and a service and involves the instant sale of one currency and the purchase of another.
2.11. The rate is the value ratio of two electronic currencies at the time of their exchange.
Section 3. Subject of the user agreement
3.1. The subject of the presented user agreement is the possibility of providing user services by the Sbs.cash service in the field of exchange of electronic and cryptocurrency.
Section 4. Procedure for providing services
4.1. The user can place an order for cryptocurrency exchange independently on the main page of the service.
4.2. The user agreement provides for the possibility of transferring funds between two individuals. The sender can use a currency convenient for the transfer, and the recipient provides him with his wallet, to which it will be easier for him to receive the transfer. At the same time, the Sbs.cash service is not a party to user interaction and provides exclusively services for the exchange and transfer of funds to the payment details specified by the sender.
4.3. The service user confirms that he legally owns and disposes of the currency at the time of the transaction. The Sbs.cash service is not responsible for the transparency of the finances exchanged by the user.
4.4. The Sbs.cash service undertakes to promptly carry out all actions to avoid changes in the rate and undertakes not to change it after creating an exchange application.
Section 5. Cost of services
5.1. The cost of using the services of the Sbs.cash service is set by its management and published on the service website.
5.2. The Sbs.cash service has the right to change the exchange rate and increase or decrease commissions unilaterally and undertakes to inform site users about this by prior posting information about changes in the appropriate section.
5.3. The Sbs.cash service charges commissions at the time of the transaction.
Section 6. Electronic currency exchange
6.1. Questions and claims on applications are accepted within 24 hours from the moment of registration. After 24 hours, the exchange requests are considered to be properly executed or not paid, depending on their status at the time of expiration of the specified period.
6.2. The service does not record the exchange rate at the time of creating the order, but recalculates the exchange rate in accordance with price changes on the exchange. The rate is fixed only at the moment when the Service has received funds from the User to its account. Funds are considered received after the actual receipt of funds to the Service account occurs or when the transaction receives the required number of confirmations.
6.3. Applications requiring the operator's participation are processed during business hours (10:00 - 23:00 Moscow time).
6.4. Applications in which 10-100 times less cryptocurrency is sent (for example, 0.1 BTC is indicated in the application, and 0.01 BTC is sent) will be paid minus 10% (the conversion fee will be deducted) from the amount received in fact.
6.5. If the User decides to cancel the application, a commission of 5% + network commission will be deducted from the amount.
6.5.1. If the Client of the sbs.cash exchange Service has already transferred funds on Request to the account of the exchange Service, then the refund of funds for such Requests is made with a deduction of a commission of 5% of the exchange amount.
6.5.2. Any refund from the client is made exclusively during business hours. The request for a refund is accepted only via e-mail [email protected] , with mandatory indication of the number of the exchange Request, the reason for the return and the details. Also note that the return letter is accepted from the mail that was specified by the Client in the Exchange Request.
6.6.1. If the card specified by the User in the application does not match the selected bank, then a refund or payment is made with a 5% commission deduction from the exchange amount.
6.6.2 If the Client's details are blacklisted by the Security Service (SB) of the payment system, and when attempting to transfer funds to these details, the account of the exchange Service is blocked, then sbs.cash has the right not to return the funds to the Client.
6.6.3 The Client must pay for the created Exchange Request exclusively for the payment details specified in it. The Client is also prohibited from making payments with details that do not appear in the Exchange Request. If the Client made a mistake in the details when transferring funds to the exchange Service, the service has the right to withhold up to 10% of the exchange amount and return the funds received to the User's details.
6.7.1. The User undertakes to pay for the application within 30 minutes and has attached a payment confirmation. It is possible to restore the Application by contacting the technical support service of the Service. At the same time, the payment amount will be recalculated at the time of the actual receipt of the payment from the Client.
6.7.2. Funds from the User to the Service details must be received in the amount specified in the Exchange Request. If the amount of funds actually transferred by the User differs from the declared amount, the Service considers this to be the User's order to perform the recalculation. Accounting will be carried out according to the actual amount. A difference of up to 5% in the declared and actual indicators is acceptable. If the deviations in the data specified in the application and the actual amount are exceeded, the Service has the right to unilaterally terminate the agreement, refuse to fulfill the application, withhold up to 10% of the exchange amount and return the funds received to the User's details. Payment of commission costs for the transfer is made from funds received from the User.
6.8. The sbs.cash Service undertakes to pay for the User's request within twenty-four hours.
6.9. The User has the right to receive consultations, both before the exchange, during and after it, through any official means of communication with the service listed on the contact page of the Service's website. The User also has the right to interact with the Service in any force majeure circumstances through official means of communication with the Service listed on the contact page of the Service's website.
6.10.1. When creating an Exchange Application, the User undertakes to fully familiarize himself with the contents of the Application and, without deviation, follow all instructions, notes, recommendations and conditions specified both in the Application itself and in the current Agreement. Any deviations from the instructions, notes, recommendations, this Agreement, and the terms of the exchange will lead to a delay in processing the Application, withholding in favor of the exchange Service a penalty fee of up to 100% (one hundred percent) of the exchange amount (depending on the severity of the violation). Also, in case of a change in the exchange rate during the proceedings, recalculation is possible at the discretion of the Service. The fact of creating an Exchange Request by the User is considered to be full agreement with the specified conditions. If the User ignores this Agreement, instructions, notes, recommendations and conditions specified in the Exchange Application, claims against the sbs.cash exchange Service about long processing of the application, recalculation, retention will not be accepted. 6.10.2. Due to the stricter requirements of banking organizations to control customer transactions and the ability to stop/freeze/reject transfers at their discretion, the exchange Service is not responsible for financial losses of Customers caused by such actions of banking organizations. In case of a delay in the exchange due to one of the above reasons, the Service will recalculate at the current exchange rate at the time of receipt of funds from the client.
6.11. The exchange service accepts payments from customers with cards of individuals. Transfers from cards of legal entities will be refunded, and related Applications will be canceled with a commission deduction of up to 50% of the exchange amount.
6.12. If it is not possible to complete the payment automatically, the exchange will be made within twenty-four business hours or the funds will be refunded minus the commission of the payment system.
By submitting an application for currency exchange, the user confirms that he has read and accepts all the provisions of this user agreement.
